Abstract

berhubungan dengan penegakan hukum  sanksi administrasi yang dianggap sebagai  upaya pencegahan terjadinya pencemaran dan perusakan lingkungan. Perlindungan dan pengelolaan lingkungan hidup adalah upaya sistematis dan terpadu yang dilakukan untuk melestarikan fungsi lingkungan hidup dan mencegah terjadinya pencemaran dan atau kerusakan lingkungan hidup. Pencegahan tersebut mulai dari perencanaan, pemanfaatan, pengendalian pemeliharaan, pengawasan dan penegakan hukum. Faktor-faktor penghambat dalam penegakan hukum lingkungan, merupakan hal yang harus di telusuri dengan cermat, karena berhubungan dengan lingkungan dan kemanusiaan. Pada kenyataannya, pembangunan berkelanjutan tentang lingkungan hidup lebih condong pada aspek ekonomi dan kurang memperhatikan aspek lingkungan dan kemanusiaan. Hal ini dapat terlihat pada beberapa jenis kegiatan pembangunan perekonomian yang berpotensi merusak lingkungan. Oleh karenanya, perlu ditelusuri mengenai penerapan sanksi administrasi dalam mewujudkan penegakan hukum lingkungan terhadap pelaku pencemaran dan perusakan lingkungan hidup. Lokasi Penelitian di Provinsi Sulawesi Utara, menggunakan metode penelitian normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus.  Di samping itu dipergunakan juga metode penelitian empiris. Persepsi pengelolaan lingkungan harus pula disertai dengan tatanan hukum yang dapat melindungi semua pihak disertai pembentukan hukum dan penegakan hukum yang konsisten. Sumber penelitian ini merupakan data primer yang diperoleh dengan wawancara serta data sekunder yakni peraturan perundang-undangan yang berkaitan dengan objek penelitian. Di samping itu dipergunakan juga metode penelitian empiris. Penelitian ini akan menunjukan bagaimana penerapan sanksi administrasi sebagai penegakan hukum administrasi lingkungan akibat pencemaran  oleh pelaku  pelanggaran hukum lingkungan.

Abstract

Digitalisasi di bidang kesehatan telah membawa manfaat besar dalam efektivitas pelayanan, namun di sisi lain menimbulkan risiko kebocoran data pasien yang semakin tinggi. Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi (UU PDP) lahir sebagai regulasi komprehensif yang mengatur pengendalian dan pemrosesan data pribadi, termasuk data sensitif berupa rekam medis pasien. Artikel ini membahas dua hal pokok, yaitu pengaturan pertanggungjawaban hukum rumah sakit atas pembukaan data pribadi pasien menurut UU PDP, serta kedudukan hukum rumah sakit sebagai pengendali data pasien. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil pembahasan menunjukkan bahwa rumah sakit dapat dimintai pertanggungjawaban hukum dalam tiga ranah, yakni perdata, administratif, dan pidana, apabila terbukti lalai menjaga kerahasiaan data pasien. Selain itu, rumah sakit memiliki kedudukan sebagai pengendali data yang menuntut penerapan prinsip legalitas, akuntabilitas, dan keamanan dalam pemrosesan data.

PENGAWASAN OTORITAS JASA KEUANGAN DAN DAMPAKNYA TERHADAP EFEKTIVITAS PERLINDUNGAN DATA KONSUMEN BANK PEREKONOMIAN RAKYAT DI BATAM

Abstract

This study aims to analyze the implementation of the Financial Services Authority (OJK) supervision of Bank Perekonomian Rakyat (BPR) in protecting consumer data in Batam City. In the context of increasing cases of customer data leaks, this study analyzes the role of OJK in maintaining the confidentiality of customer personal data in accordance with applicable laws. The method used is an empirical legal research method with a sociological and legislative approach. Data were collected through interviews with OJK Riau Islands, BPR Dana Nusantara, and BPR Danamas Simpan Pinjam, as well as literature studies. The results of the study indicate that OJK supervision contributes significantly to increasing BPR compliance with data protection standards, reducing the risk of violations, and building public trust in financial institutions. However, the effectiveness of supervision still faces obstacles, especially related to the limited number of supervisors compared to the number of BPRs that must be supervised. This study is expected to provide insight for consumers and authorities regarding the importance of data protection and encourage transparency in the financial services sector.

Abstract

Penelitian ini dilakukan dengan tujuan mengetahui bagaimana perlindungan hukum terhadap pemenuhan hak maternitas pekerja wanita dalam hubungan kerja di perusahaan swasta. Mengetahui bagaimana kendala-kendala terhadap pemenuhan hak maternitas bagi pekerja wanita di perusahaan swasta. Dalam dunia kerja hubungan pengusaha dan pekerja harus tercipta dengan baik dan  memberikan rasa keadilan serta manusiawi kepada pekerja  khususnya tenaga kerja  wanita. Persyaratan kerja harus tertuang secara rinci dan jelas tentang hak dan kewajiban perusahaan, hak dan kewajiban pekerja khususnya pekerja wanita. Tanggung jawab keselamatan dan kesehatan kerja  dalam syarat - syarat kerja yang tertuang dalam aturan internal perusahaan harus sesuai dengan peraturan perUndang-undangan dan memenuhi rasa kemanusiaan dan keadilan.  Hak dan kewajiban pekerja wanita yang tertuang tidak secara rinci dan jelas pada akhirnya akan merugikan pekerja wanita dan atau perusahaan. Peraturan tentang hak maternitas bagi pekerja wanita merupakan prosedur yang berkaitan dengan hak hak keselamatan dan kesehatan kerja sehingga akan berdampak dalam kemajuan perusahaan. Hak pekerja wanita dalam hubungan kerja yang dikenal juga dalam hubungan industrial melalui Undang Undang No.13 Tahun 2003 tentang Ketenaga kerjaan. Keselamatan dan kesehatan kerja terhadap pekerja Wanita dalam hubungan kerja didasarkan pada dua permasalahan yaitu  a). Bagaimana  pemenuhan hak maternitas pekerja wanita di perusahaan swasta, b).Bagaimana kendala-kendala pemenuhan hak maternitas bagi pekerja wanita di perusahaan swasta. Dengan menggunakan metode  penelitian hukum empiris  dan melakukan survey lapangan disesuaikan dengan sampel penelitian yang ditetapkan untuk  dilakukan, diharapkan hasil penelitian ini ada model/bentuk perlindungan hukum terhadap pemenuhan hak maternitas pekerja perempuan di perusahaan swasta. Diharapkan juga agar ada upaya upaya hukum jika terjadinya kendala dalam penerapan hak maternitas tersebut.

Abstract

Rapid advancements in information technology have significantly contributed to the escalation of cybercrime incidents, particularly hacking, which poses serious risks to individual data security and national resilience. The hacking activities associated with Bjorka highlight the fragility of Indonesia’s data protection framework. This research seeks to examine the scope of criminal responsibility imposed on hacking offenders under Indonesian criminal law while also assessing the government’s effectiveness in mitigating such offenses. Employing a normative legal research method, the study adopts statutory, conceptual, and case-based approaches, drawing on primary, secondary, and tertiary data sources analyzed through qualitative techniques. The research indicate that individuals involved in hacking may be prosecuted under Articles 30 and 46 of Law No. 1 of 2024 concerning Electronic Information and Transactions (ITE Law), facing potential imprisonment ranging from six to eight years and/or monetary penalties between IDR 600 and 800 million, in addition to possible supplementary sanctions. The Indonesian government has taken steps by establishing regulations such as the Electronic Information and Transactions Law, the Personal Data Protection Law, and the Telecommunications Law, as well as by increasing the capacity of law enforcement officials, providing digital forensics training, and engaging in international cooperation.

THE LEGAL RATIO OF RESOLVING CRIMINAL ACTS THROUGH THE PROFESSIONAL DISCIPLINARY COUNCIL WITHIN IN THE HEALTH LAW SYSTEM

Abstract

The Professional Discipline Council (Majelis Disiplin Profesi, MDP) occupies a strategic role in Indonesia’s health law system as an institution that enforces medical discipline and ethics while serving as a pre- judicial mechanism to prevent the criminalization of medical professionals. This study analyzes the ratio legis behind the establishment of the MDP to harmonize legal protection for medical workers with patients’ rights. Using a juridical-normative approach, the research examines the MDP’s position, authority, and functional relation to law enforcement bodies. The findings show that the MDP reflects the principle of lex specialis derogat legi generali, emphasizing disciplinary enforcement before criminal proceedings. However, overlapping authorities between the MDP and law enforcement agencies have led to medical criminalization and declining public trust. Strengthened policy frameworks, implementing regulations under Law No. 17 of 2023 on Health, enhanced legal competence of MDP members, and a national medical case database are needed. These reforms aim to establish a fair, proportional, and humanistic health law system, positioning the MDP as a key mechanism for substantive justice in healthcare.

Abstract

Otonomi daerah merupakan kewenangan atau kebebasan yang dimiliki pemerintah daerah agar memungkinkan mereka dalam membuat inisiatif sendiri untuk mengatur dan mengoptimalkan sumber daya yang dimiliki daerahnya. Salah satu bentuk pelaksanaan otonomi daerah adalah adanya kerja sama daerah dengan daerah lain dan kerjasama daerah dengan pihak ketiga sebagaimana yang diatur dalam Peraturan Menteri Dalam Negeri Nomor 22 tahun 2020. Dalam pelaksanaannya peran lembaga Dewan Perwaiklan Rakyat Daerah (DPRD) memberikan persetujuan sangat penting untuk terjadinya Kerjasama tersebut. Penelitian ini dilakukan dengan tujuan untuk mengkaji pengaturan kewenangan DPRD dalam hubungan dengan kerjasama daerah dan untuk mengkaji peran lembaga DPRD dalam hubungan dengan Kerjasama daerah oleh Pemerintah Daerah. Adapun metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Dalam penelitian ini pengumpulan data/bahan hukum berdasarkan studi kepustakaan dan di tunjang dengan pengumpulan data di lapangan (Penelitian empirik). Data yang terkumpul dianalisis dengan menggunakan Analisa data kualitatif. Hasil penelitian terkait dengan pengaturan kewenangan DPRD dalam Kerjasama daerah dengan daerah lain dan dengan pihak ketiga mengacu pada UU No.23 Tahun 2014 tentang Pemerintahhan Daerah dalam Bagian Kesatu Bab XVII tentang Kerja Sama Daerah dan Perselisihan. Pengaturan lebih lanjut diatur dalam Peraturan Pemerintah Nomor 28 Tahun 2018 tentang Kerja Sama Daerah. PP ini menjabarkan lebih rinci mengenai jenis, tahapan, serta mekanisme kerja sama yang dapat dilakukan, termasuk dengan daerah lain, pihak ketiga, dan lembaga internasional. Selanjutnya ketentuan lebih rinci terkait teknis pelaksanaan kerja sama daerah diatur dalam Peraturan Menteri Dalam Negeri (Permendagri) Nomor 22 Tahun 2020 tentang Tata Cara Kerja Sama Daerah Dengan Daerah Lain Dan Kerja Sama Daerah Dengan Pihak Ketiga. Adapun peran DPRD dalam Kerjasama daerah oleh Pemerintah Daerah dengan Daerah lain atau dengan pihak ketga tidak semua Kerjasama membutuhkan persetujuan dari DPRD tetapi hanya Kerjasama yang membebani masyarakat dan daerah dan/atau pendanaannya belum teranggarkan dalam anggaran pendapatan dan belanja daerah tahun anggaran berjalan.

PENGARUH PENYALAHGUNAAN NARKOTIKA OLEH REMAJA TERHADAP TINGKAT KRIMINALITAS DI LINGKUNGAN SOSIAL

Abstract

Narcotics abuse among adolescents in Indonesia has become an alarming and escalating social problem. This condition has serious impacts, not only on physical and mental health , but also has a close relationship with the increase in deviant behavior and criminal acts in society. This research aims to analyze the influence of narcotics abuse by adolescents on the criminality rate in the social environment. Based on the analysis, it was found that narcotics abuse often leads to unlawful acts such as theft, robbery, and violence. These actions are driven by various motives, including the economic need to buy drugs, as well as the loss of self-control and rational thinking abilities due to addictive substances. The results identified causal factors divided into internal and external. Internal factors include uncontrolled emotions , high curiosity , and submissiveness (inability to refuse peers). External factors include a lack of parental attention and negative influences from the social environment.

Abstract

The Red Ginger Program, which was initiated by Erzaldi Rosman Djohan, former Governor of Bangka Belitung, aims to empower the people of Central Bangka through the cultivation of red ginger by providing loans channeled through Bank Sumsel Babel. However, this program caused serious legal problems when around 400 residents involved in the program were blacklisted by Bank Indonesia (BI) due to crop failure and inability to pay off loans they considered as assistance. This creates legal uncertainty and limits citizens' access to financial services. This research uses normative juridical methods with a qualitative approach to examine legal issues arising from the provision of loans in the Red Ginger program and their impact on residents' credit status. Data was collected through interviews with affected residents, representatives of Bank Sumsel Babel, and analysis of related legal documents. The research results show that there is a mismatch between residents' expectations and the reality of program implementation, especially in terms of information dissemination and transparency. Many residents did not receive adequate explanation that the assistance was a loan that had to be repaid, thus having a negative impact on their credit record.This research reveals the need to increase socialization and transparency in the implementation of economic empowerment programs, as well as strict law enforcement to protect citizens' rights. In conclusion, a legal solution is needed that can ensure legal certainty and protect citizens' rights in future economic empowerment programs.

Abstract

This essay explores the crucial roles that political parties play in the legislature and emphasizes how important they are to representative democracy.  As the major conduit between the people and the government, political parties play a crucial role in establishing state policies and upholding a stable, responsible political system.  The main tasks that parties carry out in parliament are described in this analysis: legislation, which involves proposing, debating, and approving laws; representation, which involves directing public desires into policy; oversight, or political control, which guarantees checks and balances by keeping an eye on the executive branch; political recruitment, which involves choosing and preparing legislative candidates; and political stabilization, which involves handling conflict and preserving national stability.The study makes the case that the execution of these functions in Indonesia is fraught with difficulties, such as inadequate internal party democracy, poor cadre development, practical hiring procedures, elite dominance, and inadequate government oversight as a result of transactional coalition politics.  The study comes to the conclusion that extensive internal party reform, improved political education, and increased accountability and transparency are necessary to strengthen these roles.

Abstract

The circulation of food without halal certification raises concerns for Muslim consumers in Indonesia. Although regulations such as Law No. 8 of 1999 concerning Consumer Protection and Law No. 33 of 2014 concerning Halal Product Assurance have regulated certification obligations, many products still circulate without halal assurance. The purpose of this study is to analyze consumer legal protection and the responsibilities of business actors regarding products without halal certification. This study uses a normative juridical method with a legislative and conceptual approach. The research shows that business actors have a legal responsibility to ensure product halalness and provide transparency of information to consumers. However, the implementation of legal protection still faces obstacles such as weak supervision and low business awareness. Strengthened supervision, education, and strict sanctions are needed to guarantee consumer rights and increase legal certainty regarding halal products.

PERSPEKTIF HUKUM ATAS PEMILIK JAMINAN FIDUSIA SEBAGAI KREDITUR TERHADAP DEBITOR PAILIT

Abstract

Fiduciary guarantees as part of property rights have a strategic role in bankruptcy law, especially in determining the position and execution rights of creditors. In the condition of a bankrupt debtor, all assets become bankrupt estate, but fiduciary rights remain attached to the collateral object and provide a special position for the creditor as a separatist creditor. This allows the creditor to execute their guarantee independently, without having to submit to the general bankruptcy process, as regulated in Article 55 paragraph (1) of the Bankruptcy and PKPU Law and Article 27 of the Fiduciary Guarantee Law. These separatist rights are strengthened by the fiduciary nature that gives priority to repayment and continues to follow the collateral object (droit de suite), and is public through recording. However, through Constitutional Court Decision Number 18/PUU-XVII/2019, it is emphasized that execution of fiduciary objects can only be carried out if there is an agreement or legal proof of default, to guarantee legal protection for the debtor. Thus, the legal relationship between creditors and debtors under fiduciary guarantees remains within the bounds of legal certainty and justice in the bankruptcy process.
