Allegations of Research Misconduct Policy
Fair, confidential and evidence-based examination of research-integrity concerns.
Policy Statement. Jurnal Hukum to-ra addresses credible allegations concerning submitted and published legal scholarship. Allegations must be assessed fairly and must not be treated as established misconduct before relevant evidence has been evaluated.
1. Scope of Misconduct
Concerns may involve plagiarism, fabricated research findings, falsified interviews, manipulated documents, invented judicial decisions or legal references, duplicate publication, authorship or citation manipulation, peer-review fraud, undisclosed material conflicts, misuse of AI, or serious violations of consent and confidentiality.
2. Reporting Allegations
Submit a written report to tora.fh@uki.ac.id. Provide the manuscript ID or published-article DOI, a clear explanation and supporting documentation, such as original legal sources, publication comparisons or relevant correspondence. Evidence-based anonymous reports may be considered.
3. Preliminary Assessment
The Editor-in-Chief or authorized independent editor reviews the allegation, evaluates available evidence and determines whether clarification, editorial inquiry or institutional referral is warranted. Honest mistakes and legitimate differences in legal interpretation must be distinguished from deception or misconduct.
4. Inquiry and Procedural Fairness
Affected parties should receive an appropriate opportunity to respond. The editor may examine publication records, seek original documents, consult independent experts or request clarification from relevant institutions. Persons with material conflicts must not determine the outcome. Confidentiality is maintained as far as reasonably possible.
5. Institutional Cooperation
Universities, research organizations or competent institutions may be responsible for formal investigations of researcher conduct. The journal may cooperate with such bodies while retaining responsibility for decisions concerning its own manuscripts and publications.
6. Editorial Outcomes
Before publication: Processing may be paused, clarification requested, independent review arranged or the manuscript rejected. After publication: The journal may issue a correction, Expression of Concern or retraction when justified by the evidence. Formal notices should be linked to the published record.
7. Protection and Confidentiality
Good-faith reporting should not trigger inappropriate retaliation. The journal must safeguard identifiable participants, vulnerable individuals, confidential client information, restricted court documents and other protected legal-research materials. Allegations must not be publicized as established facts without sufficient evidence.
8. Records and Accountability
The Editorial Office maintains appropriate records of allegations, responses, assessments, institutional referrals and actions taken, subject to confidentiality and legal requirements. Decisions should be supported by clear reasons and proportionate responses.
